The privacy of your personal data has growing importance when everything digitalizes, and you use a different kinds of digital services. In Jakamo, there are a very limited amount of personal data, but it is important that you knowledge, how we handle it. We protect your privacy through organisational, technical, and physical measures based on strict policies and standards.

General Data Protection Regulation (GDPR)

GDPR means Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation). The General Data Protection Regulation is set to come into effect on the 25th of May 2018. GDPR is designed to harmonise data privacy laws across Europe, to protect and empower all EU citizens’ personal data privacy, and to reshape the way organisations across the region approach data privacy. For more information about the GDPR, please visit the EU’s GDPR Portal.

The GDPR strengthens the rights of individual persons with respect to their personal data. Furthermore, it also means that our customers need to meet their obligations as the data controller for the data processed in Jakamo Service. Besides strengthening our information security measures for protecting all personal data in Jakamo or otherwise used by Jakamo Limited (e.g. in Customer Relationship Management purposes), this also means that we need to provide features that enable our customers and individuals that use our services to exercise their rights. In order to be compliant with GDPR, Jakamo Limited commits to respond to all requirements set by the regulation.

Jakamo Limited as a Data Processor and Data Controller

A typical cloud service provider acts as both Data Processor and Data Controller. Providing the cloud service makes the service provider Data Processor in most cases. The data is processed on behalf of the customer, who is the Data Controller. But the service providers also may use some of the same personal data for their own purposes like billing, product development, and marketing and this makes them also Data Controllers. It needs to be clear for the individual user, how their personal data is handled in these different kinds of situations.

Providing Jakamo Service for our customers involves the processing of the customers’ data, including their personal data. The purpose of processing data is determined by the customers, not Jakamo Limited. This makes the customer the Data Controller and Jakamo Limited acts as Data Processor. Jakamo Limited processes the data on behalf of the customer and according to instructions given by the customer. The processing of your Personal Data while Jakamo acts as the Processor are governed, in the first instance, by the Jakamo Data Processing Addendum and privacy policies of the Companies.

Furthermore, in certain cases, Jakamo Limited acts also as a Data Controller. We process the information also for our own purposes. The purposes of the processing of personal data are e.g., customer service, user communications, billing, marketing, and service development. See the Jakamo Privacy Policy for detailed information on how Personal Data is handled. See also the separate Trust Center section, Jakamo as a Data Controller, where we tell how we collect and use data for our own purposes.

Personal Data Addendum

The data protection regulations require that the processing of personal data by a Data Processor is governed by a written contract or other written legal act. Jakamo provides Data Processing Addendum to comply with the requirements set out in the Data Protection Regulations. The use of the Jakamo Service is governed by the Service Agreement. The Data Processing Addendum forms a part of the Service Agreement.

For detailed information, see the Data Processing Addendum.
